Should fugitive dad be charged with kidnapping his own daughter?

I'm sure you have read how Clark Rockefeller has been arrested for kidnapping his own daughter in Boston, Massachusetts. Is it right to treat a not-so-simple child custody dispute like a terrorist incident? Some say that the courts rule in the mothers favor most of the time so how could the dad have been awarded custody?
 
Yes he is guilty. He grabbed the girl and took off.
 
I don't get these cases. I mean if a dad or mom really wants to see their kids but the court said no, how can you deny them that right? I mean sure there are drug addicts, alcoholics, etc out there, but I mean if these people who have these problems want to see their kids so badly, then why not? I mean lots of times children grow up stronger when they know mom or dad has an addiction problem or something they can't really easily get out of. The sad fact is that while the court denies them the rights of parents who want to really see their children, children who are outright abused are ignored. I don't get it sometimes.

I can sort of see it the other way though. Mom or dad is jealous of the other so they take the kid as a selling point. However, it's doubtful that this happens all the time especially if one takes the time to try to better themselves.

Although the creep that kidnaps a child grabs all the headlines (see JonBenet Ramsey, Elizabeth Smart, Polly Klaus), the vast majority of child kidnappings are by the noncustodial parent as in this case.

And, yes, while this is not on the same level as terrorism, he should be prosecuted.
