Our jerk neighbor is destroying our summer!

Do we have any legal rights when it comes to our neighbor's loud and dusty construction jobs?!?

My neighbor has been building a cement patio for over 3 weeks now. Any day I don't work I have to listen to the loud machines. There isn't a room in my house where I can't hear it. Also, all the sawing they are doing are sending HUGE clouds of dust through our front and back yard. Every day our cars get absolutely covered in it. I can't go outside all day while they are working monday-friday as I literally am inhaling dust and it gets in my eyes. I have to hold my breath to get to my car. This came without any kind of warning and it's getting ridiculous! Also, all my vegetables are getting covered in dust. I don't know what to do! It's ruining my summer! Do we have any legal rights here?

I have no idea how this would be with American law, but in Norway, you have to warn your neighbors if you are about to do something like that. And you have laws protecting you from noise and stuff like that.
 
Have you tried talking to them? Perhaps they don't know they're doing this, and maybe they are willing to work with you.
 
So what you're saying is instead of acting like a intelligent, good neighbor, you should instead, go right to a lawsuit?

That sounds more like the American way. Instead of talking it out and finding the other side of the story, you instead jump to your own conclusion.
 
In most circumstances, not all there are exceptions: When angry the first human impulse is "usually" the wrong outward action to produce. Retraction and reflection and looking at the various angles to the situation, and choosing a best course of action pertaining to the circumstances, is a far better approach

They have building permits and construction rights to the project being constructed? If so, do these rights to construction have the right to impose a subsequent construction reaction to the neighbors? If not, what is the best recourse to the construction bi-product reaction? Apparently, there paying for construction, and it needs to be done in their view, maybe a compromise of some sort, without creating a hostile envirnment. Seach for answers there right there in front of you.
 
I would go over and ask him how much longer he's going to be, and explain the huge stress that he's causing on you. Your neighbors might not realize how badly this is impacting you. However, if he's knee deep in construction, I doubt it's as simple as just stopping.

At the same time, contact the authorities and see what the stipulations are as far as home constructions.

The noise you may not be able to do anything about until after a certain time at night. The dust you might be able to do something about.

I'd think he'd be done within' 3 weeks. That's an awfully long time to be working on a patio.
 
I agree with Evo. Call the city and find out what the ordinances are.

Why would building a concrete patio create all that dust and whatnot? You do your dirt work, build a form, then pour and work the concrete. What's all the sawing and dusting and all that anyway?

Yeah the noise might not be anything you can complain about until a certain time of the night, but the the dust is definately a problem.He might have to get a tent to block the dust or put up a smaller one to cut the boards in so the dust can't escape.
