I go to a shitty bank

A few months ago I switched my bank because at the time I wasn't happy with the in house service at my regular bank. The new bank prides itself on being spectacular with customer care... blah blah blah.

Yesterday I went to purchase something at Target only to get my card declined. Declined?!?! I thought... I should surely have more than enough money in my account. So I call bank customer service, which was a pain to get in the first place, and then tell me that I've overdrawn. Finally make it to a computer and here's the breakdown...

A week ago I looked at my checking account... it said my rent check had just cleared that day for $xxx so I wanted to put what was left in my checking into my savings so I wouldn't spend it... I did leave a couple hundred but I stuffed away a nice sum... according to my bank the check did not clear until the night of the 14th AFTER I had put all that money in my savings account. Therefore overdrawing on my account. So I call custumer service back and explain to them that I visually saw online that my check had cleared that day and wouldn't it be stupid of me to transfer a large sum of money into my savings when it would be clear that I would overdraw on my account? They agree but still are adamant that they made no mistake. I'm not an idiot... I know how to read... I had more than enough money to cover the check so why would I put myself in such a situation? So then for the last week the bank keeps letting me use my card even though I've been overdrawing on it... I never received anything in the mail, no email and no phone call. Now I'm up to almost $600 in overdraft fees and they won't reverse those charges.

I am livid on so many levels... I had been overdrawn on my account and my card was still allowed to make charges for an entire week... I received no notification... they cashed a check without making sure there was enough money in the account to cover it. I honestly feel robbed... and I feel robbed because my statement that day told me that the check had been cleared. I plan on emailing all of the higher ups in the company, meeting with a bank manager at my local branch, and if need be I will tell every news station and newspaper in the city about what they did and how they handled it... if nothing else I want people to see how an institution will rob you of your money just because they can.

Anway, does anyone know of any legal action I can take? Any way to get my money back? Any right thing to say that will prompt them to just make me shut my mouth by giving me my money back?
 
I'm a little confused....

you've got two accounts... and you ended up with an overdraft becuase your checking ran short but the money was in savings? you don't have the ability to automatically transfer the savings? you can't get an email alert that you're overdrafting?

About 2 years ago, my wallet was stolen... and the thief, in the hours that it took for me to realize my wallet was stolen - had rung up several thousand dollars worth of charges... and severely overdrafted my account.. I honestly couldn't understand why the card was allowed to overdraft that much... it was a visa check card and it acted olike a visa...the limit wasn't based on available funds... I've since had that changed wiht my bank...
 
Are you sure that the rent check that you saw online wasn't the rent check for the previous month?
I've never heard of a check coming through the system and showing it had cleared and then coming through again... It's been years since I've been a banker. ( quit when I had my first child)
I would think if you could talk to someone like a bank manager.. and they saw that you had the money in savings in their bank.. they might take mercy on you and reverse the overdraft charges. It's worth a try. Stress the fact that you never removed your money from the bank.. only transfered in error. In the future when you view your account online you should print out the page so you would have proof that you saw the check clear.
 
Mal - The email alerts they were sending only go to the inbox of my online account... which is just dumb for the obvious reason that if I'm looking at my account I know there's an overdraft... but what if I've been busy and take a week to check on my account? The first person I spoke to over the phone said we don't call or send emails because we assume our customers check their accounts... well I did check my account at the beginning of last week!

As far as it coming back out of my savings, they told me I could set that up in case this ever happens again... for a small charge of $12 per overdraft. I was like what the fuck is the point of that? How much more do you want to rob me?

Christy- The check was definitely for that month (which pisses me off even more that my landlord takes two to three weeks to cash my check but that's another rant for another day). In hindsight printing out that page would have been a great idea but I didn't think I had anything to worry about. I did try stressing over the phone that it would be absolutely stupid of me to transfer that money when I knew my account would overdraw and all they said was, "We understand that but this is not a bank error."

Anyway Jeff and I did some googling of this institution and what people have to say about banking with them and apparently they are horrible to bank with and the Better Business Bureau thinks they're an absolute terror. There are ppl with similar stories to mine... it posted cleared online but the bank didn't clear it until later leaving the customer unable to do anything... some people had Mal's situation in which they never reversed the overdraft charges, did reimburse the money stolen, but then months later took it out of their account claiming they owed that money to said bank, and then charged them overdraft when they cleared out their account. It's just disgusting what they do. I'm hoping to go into the bank next Saturday (have plans I can't miss this weekend) and talk to the manager. But in the mean time I've started emailing all the news stations in the city.
 
sounds like the crap that I used to deal with at Wells Fargo....they are horrible!
